Terms & Acceptable Use

These Terms govern your access to and use of US Realtor List (the "Service") and any data you obtain through it (the "Data"). By purchasing or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. What we provide

US Realtor List provides access to a database of business contact information for U.S. real estate professionals, compiled from publicly accessible sources (brokerage and franchise websites and directories, real estate businesses' own websites, and state real estate license registers that publish email addresses). You can purchase a list ("CSV") for a state or city segment.

2. License to use the Data

On payment, we grant you a non-exclusive, non-transferable license to use the purchased Data for your own legitimate business-to-business outreach. You may not:

resell, sublicense, rent, or redistribute the raw Data, in whole or in part;
publish the Data or make it publicly available;
use the Data to build a competing dataset or list-selling service; or
use the Data for any unlawful, deceptive, or harassing purpose.

3. Your compliance responsibilities (CAN-SPAM, TCPA & state law)

You are solely responsible for ensuring your use of the Data complies with all applicable laws, including the federal CAN-SPAM Act, the Telephone Consumer Protection Act (TCPA), and any applicable state marketing or privacy laws.

Without limiting that responsibility, you represent and agree that you will:

use accurate header and From information and subject lines that are not misleading, and identify commercial messages as advertisements;
include your valid physical postal address in every commercial email;
include a clear, working, no-cost unsubscribe mechanism in every commercial email and honor opt-outs within 10 business days;
not use the phone numbers in the Data for text messages or auto-dialed or prerecorded calls without the prior consent the TCPA requires; and
keep your own records demonstrating your compliance.

US Realtor List does not send messages on your behalf and is not responsible for how you use the Data. Nothing on the Service is legal advice.

4. Payment, delivery & refunds

Prices are shown in U.S. dollars and charged at checkout via Stripe. A file's price counts the rows it holds. The Data is a digital product delivered immediately after payment (by download and/or email). Because the Data is delivered instantly and its value is realized on disclosure, all sales are final and non-refundable once the list has been delivered, except under the bounce guarantee below or where a refund is required by law. If you experience a technical problem receiving your file, contact us and we will make it right.

Refunds: the bounce guarantee

Email the list within 30 days. For every address that hard-bounces, send us the bounce report and we refund that row's share of what you paid. The rules:

What counts. A hard bounce means the address does not exist: the receiving mail server rejects it with a permanent 5xx error such as "user unknown" or "no such mailbox". A full mailbox, a greylisting or other temporary delay, and a block or rejection as spam are not hard bounces.
How much. The price you paid, divided by the number of rows in the file you bought, times the number of addresses that hard-bounced. The refund goes back to your original payment method.
How to claim. Within 30 days of your purchase, email hello@usrealtorlist.com with the bounce report from your email tool or server (the bounced addresses and their error messages) and the email address you used at checkout.

5. Accuracy & "as is"

We collect emails only from agents' own public brokerage profiles, from real estate businesses' own websites (rows marked "Business website", which are business addresses, not agents) and from state real estate licence registers, and re-collect them on a schedule; the build date of the file you buy is printed on every page. Contact data still changes constantly. The Data is provided "as is" and "as available," without warranties of any kind, including accuracy, completeness, deliverability, or fitness for a particular purpose, other than the bounce guarantee in section 4. We do not guarantee any specific results from using the Data. A city list contains the agents and business addresses we can place in that city and is a subset of its state file, not a census of every licensee.

6. Limitation of liability

To the maximum extent permitted by law, US Realtor List and its operators will not be liable for any indirect, incidental, special, or consequential damages, or for lost profits, arising out of or relating to the Service or the Data. Our total aggregate liability for any claim is limited to the amount you paid for the order giving rise to the claim.

7. Indemnity

You agree to indemnify and hold harmless US Realtor List and its operators from any claims, damages, penalties, or costs (including reasonable legal fees) arising from your use of the Data or your breach of these Terms, including any claim relating to your messaging or calling practices or compliance with CAN-SPAM, the TCPA, or state law.

8. Agent Verify (Shopify app)

Agent Verify is provided free of charge, as is, for use inside your Shopify store. A match means an email address appears on a US brokerage roster or state license register we hold; it is not a verification of licensing, and you remain responsible for any price or access decision you base on it. You may not use the app to look up people who are not genuinely your customers, and we may suspend a store that does. How the app handles your store's data is set out in our privacy policy.

9. Agent Lookup (Google Sheets add-on)

Agent Lookup is provided free of charge, as is, up to 250 rows a day per Google account. A match means an email address appears on a US brokerage roster or state license register we hold; it is not a verification of licensing. You may not use the add-on to rebuild or copy our data, to get around the daily limit (for example with several accounts), or to look up addresses you have no legitimate reason to hold, and we may block an account that does. 10. Changes & governing law

We may update these Terms from time to time; the "last updated" date above reflects the current version. These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there, where the operator is based.
